Review procedures

A miscarriage of justice can jeopardise a person’s life if unjustly accused and convicted at the outcome of a criminal trial that has been finalised by an irrevocable judgment. Our procedural code allows the error contained in a final conviction to be remedied by means of the revision procedure, which is provided for as an exception to the rule of the intangibility of the judgement. Among the peremptory cases of revision is also the request to reopen the trial, when this is necessary to comply with a judgment of the European Court of Human Rights.
