Preventive measures

Designed to combat social hardship such as begging and vagrancy, which have evolved as measures to combat organised crime, prevention measures have seen a dramatic expansion of their scope over the last decade. Because of the typically inquisitive nature of the prevention process, the legislation has been repeatedly censured by constitutional and Community jurisprudence for its conflict with fundamental rights to freedom, property, security and defence, making the debate on its compliance with the ECHR more topical than ever. The Firm guarantees assistance in court, both to the persons proposed for the application of the measure, and to the interested third parties, holders of a right of ownership or guarantee on the assets of which confiscation is requested, and, more generally, a claim against the proposal.
